Busby’s Gym – Terms & Conditions

1. Introduction

By purchasing a membership, day pass, or class booking, or by using our facilities, you agree to be bound by these Terms and Conditions (“Terms”). Please read them carefully.

2. Services

Busby’s Gym provides the following services:

  • Gym memberships (Bronze, Silver, Gold, Platinum)

  • Day passes (24-hour gym access)

  • Fitness classes (Bootcamp, Boxercise, Strength & Conditioning, etc.)

Important: Some classes may be photographed or filmed for marketing purposes (see Section 9).

Reformer Classes: Reformer classes held in the studio are operated by a separate entity. Bookings for these classes must be made directly via the website.

3. Memberships, Day Passes, and Access

Membership Levels:

  • Bronze: 24/7 gym access

  • Silver: 24/7 access + 4 classes per month

  • Gold: 24/7 access + 8 classes per month

  • Platinum: 24/7 access + unlimited classes + 4 reformer classes per month

Day Passes and Class Packages:

  • Valid for 24-hour access from activation

  • Non-transferable; issued to named individual only

  • Eligibility: 17 years and older (photo ID may be requested)

  • Memberships commence on purchase/activation; day passes commence immediately

  • Class credits expire at the end of the monthly billing period

QR Codes:

  • Provided on purchase for personal use only

  • Sharing or misuse may result in suspension or termination of access

4. Classes

Booking and Cancellation:

  • All classes must be booked via the website or app

  • Cancellations made at least 12 hours before the class are free; late cancellations or no-shows may result in forfeiture of credits

Class Entitlements:

  • Silver/Gold: Set monthly classes (non-rollover)

  • Platinum: Unlimited classes + 4 reformer classes

  • Day pass holders: Classes available for an additional fee

Rollover Policy:

  • Membership payments are collected monthly via direct debit from the date of purchase unless otherwise stated

  • Class credits expire at the end of each monthly period

5. Payments, Refunds, and Renewals

  • Memberships: Recurring memberships automatically renew unless cancelled (see Section 7)

  • Direct Debit Cancellation: Members may cancel their direct debit through their bank; membership access will continue until the end of the current billing period

  • Day Passes/Classes: Paid in full at purchase; non-refundable and non-transferable

  • Failed Payments: Access may be suspended until payment is received

  • Price Changes: Recurring membership fees may be adjusted with 30 days’ prior notice

6. Health, Safety, and Conduct

  • Medical Readiness: Members must confirm they are fit to participate and complete a PAR-Q where required

  • Risks: Participation in exercise involves inherent risks; members should exercise within their limits

  • Behaviour: Members must not engage in abusive, disruptive, or harassing behaviour

  • Staff Instructions: Members must comply with all staff instructions at all times

  • Equipment: Use all equipment safely and responsibly; wipe down and re-rack weights after use

  • Belongings and Lockers: Members store personal items at their own risk; Busby’s Gym is not liable for loss or damage

  • Restriction of Use: Access may be suspended or revoked for unsafe behaviour

  • Gym Attire: Appropriate clothing and closed-toe footwear must be worn at all times

  • Substances: No drugs, alcohol, smoking, or vaping allowed on premises

  • Age Restrictions: Only members aged 18 and over are permitted to use the facilities

  • 24/7 Access: Staff are not present outside staffed hours; use facilities at your own risk

Failure to adhere to these can result in immediate termination of membership.

7. Cancellations, Freezing, and Changes

  • Cooling-Off Period: Online or telephone memberships may be cancelled within 14 days of purchase if unused

  • Membership Cancellation: Requires 7 days’ notice following any minimum term

  • Freezing/Pausing Memberships: Maximum of 4 weeks per year (supporting evidence may be required)

  • Termination by Busby’s Gym: Membership may be terminated for breach of Terms, non-payment, or unsafe conduct

  • Upgrades/Downgrades: Changes to membership tier can only occur at the end of the billing cycle and are not transferable

8. Liability

  • Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability which cannot legally be excluded

  • Busby’s Gym is not liable for indirect or consequential losses; liability is capped at fees paid by the member in the preceding 12 months

9. Data Protection, CCTV, and Filming

  • CCTV: Operated in public areas only; not in changing rooms

  • Marketing Filming: Classes may be photographed or filmed; by booking or attending, members consent to this

  • Opt-Out: Members may provide written notice to opt out of marketing filming

10. Changes to Services or Facilities

  • Temporary closures may occur for maintenance, cleaning, staff training, or safety reasons

  • Timetable and instructor changes may occur without prior notice

  • Updates to Terms will be communicated; continued use of the facilities constitutes acceptance of any changes

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

12. Parking, Complaints, and Feedback

  • Parking: Vehicles are parked at owners’ risk; premises may be monitored for security

  • Complaints: Email info@busbysgym.co.uk. A response will be provided within 10 business days
